Effect of Arbitration Clause on 3rd Party Assignee

The Courts of Rotterdam recently considered a case where a carrier had incorrectly overdelivered to one consignee on a bulk cargo of soy beans, resulting an a shortage to another consignee. The defendant carrier disputed the jurisdiction of the Courts based on the arbitration clause in the bill of lading.
